Times article on “Arbitration Everywhere: Stacking the Deck of Justice”, and its references to Chief Justice Roberts helps me understand why “Stare Decisis” doesn’t follow from William O. Douglas’s opinion in U.S. versus Columbia Steel, where Douglas wrote: “… Power that controls the economy belongs in the hands of the People, not an industrial oligarchy; not subject to the whims of a few self-appointed men. …”
